Legal Agreement: Terms of Service
The Lift located at 12242 Business Park Drive, Suite 19 and 10266 Truckee Airport Road, Suite C in Truckee, CA is a community service offered by Truckee River Ventures, Inc. (TRV). By signing up for a Lift Membership you agree to abide by the community standards, terms and conditions, referenced in the following “Agreement.”
The Golden Rule. Simple. Please treat others as you wish to be treated.
Feedback. Please deliver feedback to others who may be impacting your experience and be open to feedback from others. Feedback is what makes our community stronger.
Our Never-ending List. We are always looking for ways to improve, and we welcome your ideas. Some things will work, others will not. We ask you to welcome change and be flexible. And, please let us know if things aren’t working.
Nuclei of Disorder. One dirty fork in the sink seems to attract more mess. Please help us keep our space clean. Please do not leave any personal items on flex desks overnight. Dedicated desks should be kept tidy. Put names and dates on food items in fridge. We clean the fridge on weekends.
Conference Rooms. Reserve online through the member portal. If you run out of “free hours,” members may use conference rooms, assuming they’re not already reserved.
Distractions and Noise. If someone has their headphones on, please leave them be. Use the phone booth for extended phone calls.
Air Conditioning. We set the thermostat at a temperature that makes sense for most people. If you feel it is too cold or hot in the Lift, please communicate with Community Manager.
Last at the Lift. Please turn off the lights, and make sure the porch and main doors are closed.
Guests are Welcome! First day is free. If your guest is a recurring visitor and stays more than an hour outside of a reserved conference room, please set them up with a day pass or encourage them to join our community.
And, here are the Terms and Conditions:
If you are a recurring 5day, 10day, unlimited flex and dedicated desk member, please provide 30 days notice for termination of membership. If a member does not uphold our community standards, terms and conditions, the members privileges may be immediately revoked. The Lift shall not be used for any purpose that is unlawful, prohibited, or that could damage, disable or impair any of the Lift resources, or keep other members from using the Lift resources.
You will be asked to pay every month on or before the date you first joined.
Disclaimer. TRV provides Lift services “as is” as a service and not as a lease of real property, and disclaim all warranties and conditions. The entire risk of participating in or using Lift services, remains with you.
Liability. In no event shall TRV or its agents, owners, members, or employees be liable for any damages whatsoever arising out of or in any way related to Lift services or otherwise, to the extent permitted by law. TRV will not assume liability for damages or injuries to clients, guests, or other parties that members may invite to the Lift space.
Indemnity. You hereby release, and agree to indemnify, defend and save harmless TRV, its agents, owners, members and employees, from and against all claims, liabilities, losses, damages, expenses, judgments, fines and penalties based on or arising out of your negligent actions, errors and omissions, willful misconduct or fraud, breach or violation of this Agreement or otherwise suffered in connection with your participation in Lift or use of Lift services.
Assignment. Take note that you can’t assign this Agreement without the prior written consent of TRV. You agree that exclusive jurisdiction and venue for all purposes under this agreement shall be in Truckee, California and everybody consents to such jurisdiction and venue. If any provision or portion of this agreement is determined to be invalid, illegal or unenforceable for any reason, in whole or in part, the remaining provisions of this Agreement shall be unaffected and shall remain in full force and effect to the fullest extent permitted by law.
Acknowledgement. By registering this Membership, I acknowledge that I have read the above terms of this Agreement, in their entirety, and that I understand and agree to abide by the above Agreement and by Local and California Rules and Regulations.
